End User License Agreement
This is a translation provided for convenience. If it differs from the Ukrainian version, the Ukrainian version prevails.
1. Parties
The parties are the Licensor, Individual Entrepreneur Kyrylo Holovchenko (see the Public Offer at /en/offer), and the Licensee (the end user who has purchased a license or uses free mode).
2. Subject matter
The Licensor grants the Licensee the right to use the Tessera application under this agreement.
3. Scope of rights
The Licensee receives a non-exclusive end-user right to use the application. The right does not include reproducing, distributing, or sublicensing the application or the license key. The number of users may not exceed the number of seats purchased.
4. Updates
The license is perpetual. It provides access to builds released within 12 months of the purchase date. Builds released later run in free mode, limited to 10 hosts, until a new license is purchased.
5. Refunds
Within 14 days of payment the Licensee is entitled to a refund on request, without giving a reason; the procedure is set out in the Public Offer (see /en/offer). After the refund the keys of the order are revoked and the application switches to free mode at its next launch with an internet connection.
6. Liability and warranty
The application is provided “as is”. To the extent permitted by law, the Licensor does not warrant that the application will be uninterrupted or error-free, or that it will fit the Licensee's particular purpose, and is not liable for indirect damages, data loss, or lost profits arising from the use of the application. The Licensor's total liability is limited to the amount the Licensee paid for the license. The Licensee is solely responsible for its credentials and for access to the remote systems it connects to through the application. Nothing in this agreement limits consumer rights that cannot be limited by law.
7. License verification
The application periodically sends an installation identifier and the license identifier to verify the seat count. Details are in the Privacy Policy (see /en/privacy).
